Declaratory Statement: Jell-O Shots?

The Division of Alcoholic Beverages and Tobacco recently responded to a request for guidance related to whether a state license is required to manufacture and sell alcohol infused gelatin. The Division succinctly analyzed the applicable statutes to determine that while a “Jell-O shot” is not a drinkable liquid, it is subject to Florida’s Beverage Law by virtue of it containing “ethyl alcohol, ethanol, spirits of wine in any form.”
