This legislation amends section 561.42(14) of the Florida Statutes to allow a retailer to accept glassware from a distributor, at no charge, as long as the conditions laid out in the following paragraph are met.
The glassware must prominently and permanently advertise a brand name. The distributor may not give the retailer more than 10 cases per calendar year, per licensed premises. Any free glassware given by a distributor must have also been provided to them at no charge. Records relating to the sale or gift of glassware must be kept for three years. Manufacturers and importers must provide a no-charge invoice when glassware is given to a distributor. The retailer may not sell the glassware or return it to a distributor for cash, credit, or replacement.
Current law is much more restrictive. A manufacturer, distributor, importer or registrant of malt beverage is only allowed to sell "expendable retailer advertising specialties" (trays, coasters, menu cards, napkins, cups, glasses, etc.), to retailers at the seller's actual cost (or higher).
The law will take effect on October 1, 2018.
